#EndSARS: Judicial Panel Urged To Prosecute Retired Police Officer

The Edo State Judicial Panel of Inquiry on Police brutality, on Monday, received a petition to invite, investigate and prosecute a retired Police officer over the shooting and killing of Citizen Ibrahim Momodu in May 2013.

The petition dated 27th October 2020 was filed by counsel to the family of late Ibrahim Momodu, Mr Jefferson Uwoghiren against retired Chief Superintendent of Police, Carol Afegbai.

Part of the petition read, “Recall that On 27th May, 2013, at Obayuwana Junction, along Siluko Road, Benin City, one Mr. Amadin Idahosa, a Corporal with the Nigeria Police and Orderly to then CSP Carol Afegbai DPO, Ogida Police Station, Benin City, at about 7pm, without provocation, legal justification, illegally and wrongly shot and killed Mr. Ibrahim Momodu, and subsequently in attempts to cover up, buried the said Mr. Ibrahim Momodu in a shallow grave in a public cemetery in Benin City.

“The family of late Mr. Ibrahim Momodu subsequently briefed us to unravel the circumstances of the brutal killing, where upon we insisted upon the exhumation of the remains of Mr. Ibrahim Momodu.

“On the 5th June, 2013, on the order of Court, the body of Ibrahim Momodu was exhumed from a shallow grave at the Third Cemetery, New Benin, Benin City, in the presence of Dr. Victor James Ekanem, an Associate Professor and Consultant Pathologist, Department of Pathology, College of Medicine, University of Benin, Benin City, Lawyers, the Press and the Police Medical Team, led by Dr. Wilson Akhiwu, then a Commissioner of Police.

“That the exhumed remains of Mr. Ibrahim Momodu was taken to Stella Obasanjo Hospital, Benin City, for Autopsy.

“That the result of the Autopsy showed that late Mr. Ibrahim Momodu was shot in the chest, lacerating his heart. That embarrassed by the circumstances of the killing, the Police arrested the said Mr. Amadin Idahosa, subjected him to Order Room Trial, dismissed him from the police and charged him to Court for murder on Charge No. B/CD/24C/2014.

“At the close of trial, Hon. Justice R. Irele-Ifijeh, in 2016 found Mr. Amadin Idahosa guilty of manslaughter in the unprovoked and illegal killing of Mr. Ibrahim Momodu and sentenced him to Life Imprisonment”.

The petitioners are demanding the arrests and prosecution of all Police Officers who were on duty and present during the killing of Mr. Ibrahim Momodu, for complicity in the murder.

They also demanded a N50 Million compensation for loss of affection, emotional distress and grave injustice done to the family of the late Momodu, by agents of Government, sworn to protect lives and properties.

According to the petition, “We demand information on the location of Mr. Amadin Idahosa, following the recent jailbreaks.

“We demand a public apology from the Nigeria Police, for defaming the family of the late Momodu by calling them, ‘ Parents of Armed Robbers and Criminals’. .

“We demand the renaming of the adjourning road and administrative block at Ogida Police Station, Benin City, after the late Mr. Ibrahim Momodu”.

The petitioner said, they also want the naming of a street within the Court premises, in Edo State after legal practitioners working pro bono, “to abate extra Judicial killings, to encourage access to justice for the poor and vulnerable”.
